General Terms and Conditions - Version 01.07.2022Fassadengrün e.K. (in the following "FassadenGrün"), Brandiser Straße 69 in D-04316 Leipzig
01 Scope of Application / Contracting Party
These terms and conditions apply to all of FassadenGrün e.K. (Contracting Party) sales to consumers and entrepreneurs.
02 Planning
The planning of climbing plant trellis systems must be done in accordance to the company homepage "fassadengruen.de". The statements and information concerning the selected wire rope trellis system, especially the maximum distance between wall mount to wall mount, as well as the information on the product sheets and links should be heeded. The wire rope system construction type (easy, light, medium, heavy, or massive) must be chosen in accordance with the wall type and the selected plant. The information on plant maintenance and trimming must be considered as well. All planning indications are given to the best of our knowledge, customers however are responsible for choosing a product adapted to their individual case.
03 Orders / Prices / Shipping Costs
Order placements are done on fassadengruen.de or via e-mail, telephone, fax, or letter. Prices are published in the online shop. Commercial customers can be given access to b2b prices.
04 Conclusion of Contract / Delivery
Every incoming order will be confirmed, by e-mail or by dispatching the order. The order confirmation or the dispatchment are considered a conclusion of contract and are subject to the delivery capability of the sub-suppliers. FassadenGrün bears the shipping risk. The stated delivery times of the individual products are indicated in the online shop. No claims can be derived from delays in delivery time .
05 Payment / Reservation of Ownership
The shipment is on account, and following payment is done via bank transfer. Shipment can exceptionally occur against payment in advance. The delivered products stay FassadenGrün property until complete payment.
06 Support for the Installation
FassadenGrün may offer help for the installation of our wire rope trellises. English language telephone help is only available when an english-speaking employee is present in the office.
07 Right of Return
FassadenGrün grants a three month period for the right of return, starting from the day of the conclusion of the contract. For consumers who order via mail order, the law prescribes the cancelation policy.
08 Cancelation Policy for (Private) Consumers in the Mail Order Business
Customers have the right to withdraw from a contract concluded with FassadenGrün e.K., without giving reasons, within a time period of 3 months. The 3 month period starts from the day the customer or from the customer commissioned third person, who is not the carrier, obtains the ordered products. To exercise the rights of withdrawal, the customer has to send

a clear declaration (e.g. Mail, Fax, or Email) of the withdrawal. The customer can use the conveyed model forms, but does not have to. It suffices to send the withdrawal before the period of 3 months has expired, to keep the terms.Result of the Withdrawal: As soon as the customer has formally withdrawn from the contract, FassadenGrün will reimburse all payments received from the customer, including the cost of delivery, without undue delay and in any event not later than 14 days from the day FassadenGrün receives the withdrawal. FassadenGrün will carry out such reimbursement using the same means of payment as the customer has used for the initial transaction, unless the customer has expressly agreed otherwise. The customer will not incur any fees as a result of such a reimbursement. FassadenGrün can withhold the reimbursement until the order is returned or the customer has given proof of dispatch.The customer needs to return the ordered products in any case within 14 days from the day of the withdrawal (with a choice parcel service or personal delivery). If the return parcel is dispatched within the 14 day period the terms are kept. The customer pays the return, FassadenGrün will reimburses the costs. FassadenGrün obliges not to allege deterioration.
09 Claims for Defects
A legal warranty period of two years applies. However, high grade stainless steel products from FassadenGrün are designed to last forever. If problems arise after the warranty period, FassadenGrün will try to find a solution together with the customer.
10 Data Protection
With the issuing of a contract the customer declares his or hers consent that FassadenGrün saves, processes, and uses personal data, stated through an order, within the scope of customer relations. All customer data is treated confidential. A usage for advertisement purposes is excluded. Further information on data protection can be found on our website fassadengruen.de under Data protection.
11 Place of Performance and Jurisdiction
Place of performance and jurisdiction for all legal disputes from the contractual relationship are in Leipzig, provided the purchaser is an entrepreneur. FassadenGrün reserves its right to file suit at the main office of the customer.
12 Final Clause
Any individually invalid part of these terms and conditions does not influence the terms and conditions as a whole.
